Losing a loved one unexpectedly is tragic in any situation. It can be particularly difficult for survivors to cope with losing a family member due to their employment. The deceased employee’s efforts to support the family result in his or her premature demise. The entire family has to adjust to life without that individual, as well as the loss of his or her financial support. Those grieving a sudden and tragic work incident may question what rights they have.

The Pennsylvania workers’ compensation program has provisions in place for workplace fatality scenarios. Medical coverage can pay for any care the worker required before his or her passing. There are also two key benefits available to the surviving family members of people who die at work or because of their employment.

Funeral benefits

The cost of holding a memorial service and interring a family member can create significant financial strain. In some cases, families may not be able to afford to honor their loved ones the way that they want with the resources they have on hand.

The Pennsylvania workers’ compensation system protects families by providing up to $7,000 in burial and funeral benefits. Those funds can help cover the cost of internment, cremation or a memorial service. Families can use their resources for other expenses instead of worrying about affording an appropriate funeral.

Survivor benefits

When workers sustain injuries that force them to take time off, workers’ compensation can provide disability benefits to replace their wages. There is a similar benefit in place for the surviving family members of an employee who dies at work.

The number of surviving dependents and the nature of their relationship to the decedent influence the value of the benefits provided. If the deceased worker has a surviving spouse but no dependent children, the benefits available can pay up to 51% of their average weekly wage. There are higher benefit amounts available in scenarios where there are also dependent children. The maximum benefits available can replace up to two-thirds of the deceased professional’s average weekly wage.

Having support while navigating a workers’ compensation claim can help those already struggling with the effects of grief and sudden financial stress. Workers’ compensation can cover end-of-life medical costs, funeral expenses and lost wages for those who lose a loved one due to their employment.
