Do I Have UM/UIM Insurance?

In Pennsylvania, your insurance company is required to offer you uninsured and underinsured motorist’s coverage equal to the amount of liability coverage that you carry. If you have insurance on more than one vehicle, you may also be able to stack your UM/UIM coverage. For example, if you carry $100,000 in liability coverage on two vehicles, you can stack that insurance so you have $200,000 in UM/UIM coverage.

If you do not have this coverage, the insurance company must prove that you rejected it by providing a UM/UIM rejection form, rejection of stacking form, or sign-down form to buy less UM/UIM coverage. If the insurance company cannot produce these documents, it may be forced to provide you coverage even if you have not been paying for UM/UIM coverage.

Do I Need a Lawyer to File a UM/UIM Claim?

When you file a claim against your own insurance company, it may assume an adversarial position to your interests. The insurance company may offer to pay you far less than your claim is worth or even deny your claim if you make a mistake. To protect your right to full compensation, you should contact a lawyer as soon as possible.

Will My Insurance Company Raise My Rates if I File a UM/UIM Claim?

Under Pennsylvania law, your insurance company cannot raise your rates if you were not at fault for the accident.
